论音乐作品的著作财产权保护

摘 要：音乐作品主要被以广播、表演以及网络传播的方式使用，因此音乐作品的广播权、表演权以及网络传播权是著作权人主要的、极易受侵害的财产权利。现今社会大量存在着广播、电视中无偿使用音乐作品的问题；营业性场所的机械表演问题；以及网络音乐免费传播的问题。我国现行著作权法对音乐作品财产权的保护尚不完善，因此要继续规范著作权的法定许可和合理使用制度，完善著作权集体管理制度和网络传播制度，切实加强对音乐作品的保护。

Abstract: Musical composition primarily used by broadcast、performance and network communication, so the right to broadcast musical works、performing rights and the right of network communication is a major and vulnerable to violations of property rights. Nowadays there are a lot of question about free use in radio and television; place of business of the mechanical performance issues; and the problem of the spread of online music for free. China's current copyright laws protect the property rights of music is not perfect, so to continue to regulate the statutory copyright license and the rational use of the system, improve the system of collective management of copyright and the network communication system and strengthen the protection of musical works.
